Article 1 - General Provisions

1.1 Purpose

These conditions govern sales by the company ADDAXA – 2 cours Jean Jaurès 38000 Grenoble, of ink pads, engraved plates, and embossing press.

1.2 Contractual provisions

By making a purchase, the customer is presumed to have accepted all the clauses of these general terms and conditions without any reservation.

1.3 Modification of the General Terms and Conditions

The seller reserves the right to modify its general terms and conditions of sale at any time. The applicable terms and conditions are those in effect on the date of the order.

Article 2 - Price

2.1 Terms of Sale

The customer can order via the Pop-stamp.fr website. Pricing is indicated on the product page.

2.2 Selling price

Product prices are shown in euros inclusive of all taxes . The applicable VAT rate is 20.00 % , as in force in France . The company reserves the right to change its prices at any time .

2.3 Price change

Price adjustments are not applied retroactively to confirmed orders.

2.4 Delivery charges

The delivery charges are as follows :

In metropolitan France :
Standard delivery - 2 to 5 business days : €7 (free for orders of €150 or more )
Express delivery - 1 to 2 business days : €12

In French overseas territories :
Standard delivery
- 3 to 9 business days : €15
International Europe
: Standard delivery - 3 to 9 business days : €15

Article 3 - Orders

3.1 Production launch

Orders are generally processed within 1 to 2 business days after payment is received, but this timeframe may be extended up to 5 business days if we encounter any issues with the file provided. Orders placed with express delivery are given priority.

Once production has begun, orders cannot be canceled or modified. In the event of a delay, the Popstamp team will contact the client to inform them. If a proof has been sent to you, the production time will vary depending on your response time and any necessary revisions.

3.2 Customized Products

The client is responsible for the content (texts, logos, visuals) and must check it carefully before validation.

3.3 Proof (BAT)

The proof (BAT) is sent by email only if the graphic designer deems extensive retouching of the image necessary or if the client has opted for the paid mockup service. In case of any issues, the order is paused and the client is contacted.

The proof will be sent to the email address you provided when placing your order. If we do not hear back from you within 3 days, the order will be considered confirmed and will be put into production according to the version we deem most suitable. Please remember to check your spam/junk folder.

3.4 Right of withdrawal

Once the order has been produced, it is no longer possible to cancel, modify or return it; a refund will also not be possible.

In accordance with Article L.121-20-2 3°, the 14-day right of withdrawal mentioned in Article L.121-21 cannot be exercised for goods made to the consumer's specifications or clearly personalized.

Article 4 - Payment

4.1 Payment methods

Confirming your order implies an obligation to pay the indicated price, in euros. The buyer can choose from the available payment methods:
- Credit/debit card
- PayPal
- 3x payment without fees
- Payment

Any order placed on the Pop-stamp.fr website implies acceptance of these Terms and Conditions. Any order confirmation constitutes your full and unreserved acceptance of these Terms and Conditions of Sale. All data provided and the recorded confirmation will serve as proof of the transaction.
You declare that you are fully aware of this.

Order confirmation will constitute signature and acceptance of the transactions carried out.
The card is debited at the time of order confirmation.

To prevent online fraud, your order details may be shared with third parties for verification purposes.

4.2 Validation and proof

Order confirmation implies acceptance of these Terms and Conditions and constitutes proof of the transaction.

Article 5 - Provision of files by the client and customization

5.1 Provision of files by the client

The client provides the files necessary for printing and is fully responsible for the entire content of their files.

The Client agrees to provide a file of optimal quality, in monochrome format (without shades of gray or color) and in one of the following formats: PDF, PNG, or SVG. The submitted file must exactly match the desired appearance on the printed medium.

Our products are intended for use on paper, so we cannot guarantee results on other materials such as fabric, aluminum, plant matter, or others.

To ensure optimal readability, we recommend using a font size of at least 8 points. Furthermore, negative files (black background with white text) and overly complex files should be avoided, as they may compromise the quality of the final output.

PopStamp reserves the right to make necessary modifications to the provided artwork to optimize the final result, without prior notice to the Client. Similarly, if the chosen medium is unsuitable for the submitted artwork, PopStamp may modify it to ensure a satisfactory outcome.

The Client accepts without reservation the technical constraints related to the manufacture of the stamp. In the event of re-engraving of a product already produced, PopStamp cannot guarantee a copy that is strictly identical to the original order.

During checkout, a "comments" section is available for the Client to describe their project, indicate any changes to be made to the image, or specify any constraints, such as a precise size. If no information is provided in this section, we cannot be held responsible for any unwanted modifications. By default, we automatically adjust the image size to fit the chosen medium, with a margin of error of a few millimeters.

5.2 Copyright and Counterfeiting

Any order relating to the reproduction of a design, model, trademark, or other item protected by the Intellectual Property Code implies that the Client affirms the existence of a reproduction right in their favor. In the event that an order gives rise to an infringement action, it is expressly stipulated that the client alone shall bear the burden of any civil penalties and all costs incurred by pop-stamp.fr.

If the conditions are not met, pop-stamp.fr reserves the right to make the necessary changes to ensure compliance with printing requirements.

The digital proof (BAT) makes the Client responsible for the document's content. Printing visual elements relating to characters or trademarks, and printing or reproducing all or part of any currency (coins or banknotes) is strictly prohibited and will result in direct liability.

Article 6 - Stock

6.1 Availability

Products are available as long as they are displayed on the website.

6.2 Out of stock

If the ordered product is not or is no longer available, the seller will immediately notify the buyer and may offer a product of similar quality and at the same price, or failing that, a voucher of equivalent value, usable for a future order.

In case of disagreement on the part of the buyer, the seller will make a full refund within two months.

Article 7 - Delivery

7.1 Deadlines

The products are delivered to the delivery address indicated during the ordering process via the transport method indicated on the order confirmation page.

The following delivery times are indicative only; the website pop-stamp.fr cannot be held responsible if the carriers do not meet them:

- Standard delivery via Colis Privé / Colissimo:
For deliveries within mainland France. The estimated delivery time is 2 to 5 business days, excluding weekends and public holidays, with delivery to the mailbox without signature, between 9 am and 1 am.

- Express delivery:
Shipping is via Colis Privé J+1 / Chronopost for deliveries within mainland France. The estimated delivery time is 1 to 2 business days, excluding weekends and public holidays, with signature required upon delivery between 9am and 6pm.

- Delivery to French overseas departments and territories, Switzerland, Belgium and Luxembourg:
Shipping is via Colissimo for €15. The estimated delivery time is 3 to 6 working days, excluding weekends and public holidays, with delivery to the mailbox without signature.

In the context of returning an item from an order, the company reserves the right to return the item via postal services, namely by tracked letter.

For deliveries via "Colis Privé / Colissimo" and "Colis Privé J+1 / Chronopost", the choice of carrier is made automatically based on availability in your delivery area and cannot be subject to a choice.

7.2 Terms and Conditions

If the shipping company has difficulty delivering the package to the address provided, it will automatically be left at a collection point (except for tracked letters). It will be your responsibility to collect your package from the designated collection point within 10 business days. Otherwise, the package will be returned to the sender after an additional 10 days.

Addaxa cannot be held responsible for delivery delays due solely to customer unavailability after several appointment proposals.

For deliveries to a Pickup Point (Colis Privé), the person named on the invoice must present themselves at the pickup point with proof of identity to collect their parcel within 10 business days. After this period, the parcel will be returned to the sender. You will be notified by email and SMS when your parcel is available.

ADDAXA SARL is authorized to make partial deliveries.

7.3 Delivery problems

The package tracking link is available on the order tracking page, the address of which is sent to the customer by email. In case of any issues with the carrier (for example, a package marked as delivered but not received), it is the customer's responsibility to contact the carrier to report the problem. The company will, however, also file a claim with the carrier.

No possible delay in delivery will entitle the buyer to cancel the order.

Article 8 - Warranty

8.1 Product Conformity

All our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, as provided for in Articles 1641 et seq. of the French Civil Code. In the event of a product's non-conformity, it may be returned, exchanged, or refunded.

8.2 Complaints

All claims must be made by email within 30 days of delivery . Your order invoice will serve as proof of purchase for the warranty and must be provided , along with a photo of your item and the subject of the claim . Without a photo of the product , the claim cannot be processed .

Broken :
Upon receiving the package, it is advisable to check the condition of the ordered products in the presence of the delivery person. Any damage occurring after the order delivery date will not be covered by the warranty.

Degradation:
Any damage occurring after the order delivery date will not be covered by the warranty.

Article 9 - Responsibility

The products offered comply with current French legislation.
Furthermore, ADDAXA cannot be held responsible for damages resulting from misuse of the purchased product.

Finally, ADDAXA cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, including service interruptions, external intrusions, or the presence of computer viruses.

Article 10 - Applicable Law in Case of Disputes

10.1 Jurisdiction

These Terms and Conditions are governed by French law. The French courts have jurisdiction.

10.2 Amicable resolution

In accordance with regulations, a consumer mediation service may be available. However, the consumer can only contact the mediator if they have first attempted to resolve the dispute in writing directly with the professional in question or their customer service department. If this first step has not been taken, the mediation request will be inadmissible.

In accordance with Article L. 612-1 of the Consumer Code, the consumer, subject to Article L.612.2 of the Consumer Code, has the option of submitting a request for amicable resolution through mediation, within a period of less than one year from his written complaint to the professional.

ADDAXA has designated, by membership registered under number 16244/VM/2504, SAS Médiation Solution as its consumer mediation entity.

Any simple or hypertext link is strictly prohibited without the express written consent of ADDAXA.

11.3 Archiving

Addaxa will archive purchase orders and invoices on a reliable and durable medium, constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code. Addaxa's computerized records will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.
